TENDER NOTICE.

Sealed tenders are invited from reputed transporters for transportation of Telephone Goods from our factory premises, Peerbagh, Hyderpora, Srinagar to various stations all over India. Transporter should be duly registered with transport authority of India & should have their own agencies outside J&K State for operating all over India. Tender documents will be issue on any working day from 10.00AM to 3.00PM against DD payment of Rs.300/=(Rupees three hundred only) from 16-07-2009 to 25-07-2009 Sealed tenders duly filled in should reach to this office on or before 01-07-2009 by 3.00PM. We reserve the right to accept or reject any tender without assigning any reason whatsoever. The tenders will be open on 03-07-2009 at 11.30 AM.

TENDER INVITATION: GENERAL REQUIREMENTS

Tender No. JK/SD/82/

 

Subject: - Tender for transportation of Telephone goods by Road from I.T.I. Ltd; Hyderpora, Peerbagh, Srinagar - 14 to various Stations all over India for a period of Two years from the date of appointment.

 

  1. This Tender shall be known as the Tender for Transporatation of Telephone goods between ITI Hyderpora, Peerbagh, Srinagar and various Stations all over India and will be referred to herein under as "Road Transport Tender".
  2. This Tender Form is not transferable. No counter terms and conditions other than those mentioned in the tender are acceptable.
  3. The Tender (Herein after referred to as the transporter) shall quote his minimum rate for transporatation from the premises of ITI Hyderpora, Peerbagh, Srinagar to various Stations in India on `Door Delivery' basis as per the terms and conditions of the tender. The Offer shall be valid for 90 days from the due date. The tender shall be submitted in sealed cover addressed to Asstt. Manager, ITI Limited, Srinagar duly subscribed."TENDER FOR TRANSPORATATION OF TELEPHONE GOODS BY ROAD" shall be submitted on or before _____________. Signature of transporter should appear on the pages of the Tender with Official Seal. Tender received after this date will not be considered.
  4. The rate quoted for full truck load shall be inclusive of charges for door delivery, loading and unloading both at points of despatch and destinations.
  5. Other terms and conditions are given at Annexure - II and Annexure - III.
  6. ITI reserves the right to accept or reject the tenders received without assigning any reason whatsoever and their decision will be final and binding on the transporter.
  7.  

  8. ITI cannot give any guarantee regarding quantum of load or any minimum/maximum loading for any particular time/period. It is the responsibility of the transporter to arrange transportation of the consignments irrespective of load involved by providing adequate number of trucks as and when required.

FOR TRANSPORTING OUR TELEPHONE GOODS

WE SELECT OUR TRANSPORT CONTRACTORS, WHO BESIDES QUOTING COMPETITIVE RATES, SATISFY THE FOLLOWING IMPORTANT CRITERIA: -

  1. Experience in transporting Engineering Goods and delicate items.
  2. Experience in transporting from Srinagar to the places mentioned in the tender.
  3. Possession of sufficient number of lorries registered in own name and ability/capacity to provide vehicles at short notice.
  4. Experience in loading and unloading and other door delivery, door collection of Engineering Goods and delicate items etc.
  5. Running contracts with large Undertakings preferably Government and Public Sector Undertakings.
  6. Adequate and well protected godown facilities.
  7. Good communication facilities like Telephone (Land line/Mobile/FAX/e.Mail/Website etc).
  8. Tenderers should be the members of Bankers Associations.
  9. Tenderers should be having "PAN" holders.

TERMS AND CONDITIONS OF CONTRACT

 

1a. The freight rates are to be as per proforma annexed on weight/volume basis i.e. per MT. by weight & per Cu. Mt. by volume.

1b. The contract is for all the places/states for outgoing material shown in proforma. Operation on selective places/states is not permissible unless mentioned on the contract itself.

1c. The transporter shall be fully responsible to comply with the latest motor vehicle act/rules and subsequent amendments.

1d. The rate quoted will be determined per METRIC TON by dead weight or by volume (Cum) in the case of bulky and light articles.For the purpose of calculation 1.5 Cu.Meter will be reckoned as equivalent to One Metric Ton subject to the maximum limit of 10 Metric Ton for the purpose of transportation of full lorry load against specific request from ITI, and payment thereof, the capacity of lorry will be reckoned as 10 Meteric Ton maximum by dead weight or 15 Cu.M.Maximum on volume. The rate quoted shall be inclusive of loading and unloading charges both at the point of despatch and destination and should be strictly on DOOR Delivery basis.

1e. The transporter shall issue G.C. notes/bills etc, on their own name as ITI will not admit carriage documents of other transporters whether they are sister concerns of the carrier or not and no payment will be made for Bename carrier.

 

2) Octroi and Toll Charges

  1. The octroi and toll charges in respect of Government Consignments will not be paid by the company transporters responsible to collect octroi exemption certificate from ITI in respect of places wherever the same is applicable before lifting the consignments. Transporters are responsible to intimate before hand if any such charges have been introduced so that company can arrange to get necessary certificates for settlement with Municipal authorities. In case transporters fail to collect the required documents while lifting the consignment incur any expenditure towards octroi charges etc., the same will not be admitted for payment. However, against written approval of ITI, material will be sent to destination without octroi exemption certificate. In such cases ITI will arrange for timely release of consignments at site. With regard to non-Govt. consignments the actual octroi/toll tax charges if paid, may be claimed by the transporter separately duly supported by proper vouchers.
  2. In respect of consignment transported to such places where terminal tax is to be paid by the transporter, which is to be paid on weight basis, the same may be reimbursed to the transporter on the claim duly supported by the vouchers.

 

3) ESCALATION IN RATES

  1. NO RESERVATION IN RATES ARE ADMISIBLE DURING THE PERIOD OF CONTRACT FOR ANY REASONS INCLUDING LOSS OF MATERIALS/ TRUCKS ETC. EITHER BY RIOT, STIRKE OR ANY OTHER REASONS WHATSOEVER (EXCEPT AS INDICATED BELOW), AND THE CONTRATUAL OBLIGATIONS ARE TO BE FILLED BY THE CONTRACTOR FAILING WHICH LIQUIDATED DAMAGES CAN BE CLAIMED BY COMPANY IN ADDITION TO RECOVERY OF THE EXTRA COST INCURRED IN GETTING THE WORK DONE THROUGH SOME OTHER AGENCY.
  2. However, only in the case of increase/decrease in the diesel basic rates by Government action, such as increase/decrease in the basic price and increase in Government levies and duties on diesel and escalation in rates as per the following formula shall be allowed from the date of revised Diesel rate exceeds/decreases the previous diesel rate by more than 25 paisa per liter. For this purposes only the basic rate of diesel prevailing in Srinagar on the due date of the tender and subsequent revisions from time to time as per Indian Oil Corporation circulars will be taken into consideration. Any increase on account of other items such as Transport spare parts including tyres/tubes etc. non-diesel oil and other budgetary levies will not be paid as the same is deemed to have been covered in the rates quoted which will be firm for the period of contract.
  3. FORMULA:

    NOTE:

    The above formula is applicable on weight basis prorate increase will be given on volume basic rates. Similarly, the formula becomes applicable when Diesel rates are decreased.

  4. At the time of quoting rates (for enclosed annexure of the tender), diesel rate at Srinagar may be taken into account, and rate of diesel at Srinagar as on agreement date, will be treated as base rate.

 

4) FREE DELIVERY and POD Submission

a. Since time is the essence of the contract, it is expected that the transporter shall deliver the goods entrusted to them for carriage within the shortest possible time for which the following specified period is allowed as free delivery period. The days allowed are exclusive of booking and delivery date of consignments. In case the transporter fails to deliver the goods within this specified period they are not entitled for full freight for delay in delivery of consignments. For MMV 9 Cu.Mt./4.5 MT. will be taken as FTL, for the purpose of free delivery and POD submission period.

Further execution of delivery shall suffice by POD (Production of proof of despatch) by the transporter; in cases where consignment is claimed to be delivered and its POD's not available for some reason for the payment purpose this will constitute as not delivered.

4b. LIQUIDATED DAMAGED:

For such delayed POD submission of consignments, Transporterís bill will be settled strictly on the following basis excluding the date of loading/un-loading:

Srinagar Jammu National Highway is the only surface link which connects the Valley with the rest of the country. The Highway is not an all weather road as it can be closed for traffic anytime due to landslides, snowfall, and slippery condition of the road.

In case the road remains closed L.D. clause can be relaxed accordingly subject to production of documentary proof.

 

4c. SUBMISSION OF ACKNOWLEDGEMENT

It is the responsibility of the transporter to get proper acknowledgement of the consignment with date & Stamp on consignee copy of GC note (Photocopy will not be valid) and submit the same to Shipping deptt. within time mentioned in clause 5a. (date of receipt will be excluded for the purpose of calculation). After verification by Shipping deptt, the same/photocopy (Certified by Shipping deptt.) will be returned to transporter for the purpose of raising bills immediately.

4c. The transporter or his representative shall comply with the security regulations with regard to entry, exit from, and the movement inside the premises of ITI.

4d. The transporter shall ensure that all employees/persons engaged/authorised by him for carrying the work behave properly with the company service. In the event of any misbehaviour/complaint reported by the officer/staff concerned of ITI the transporter shall immediately withdraw such officer/employee/persons from the work within the fortnight. In the even of non-compliance of above para dispatches of materials as well as payment of freight bills will be stopped.

 

5) RESPONSIBILITY OF TRANSPORTERS

  1. It shall be the responsibility of the transporter to transport the goods entrusted by company in vehicles conforming to respective Government Regulations and fully Licensed in that behalf.
  2. Transporters have to ensure safe delivery of the consignments irrespective of value of the consignment being and not being covered by insurance. They will not have any lien on the material. The material being given for transportation will be sole property of ITI Ltd., Srinagar, J&K.
  3. SHORTAGE/DAMAGE/LOSS TO THE CONSIGNMENT DURING TRANSIT

In case any shortage/damage/loss is observed or any accident occurs during transit for outgoing consignments, transporter will lodge FIR at the nearest Police Station followed with appointment of Surveyor from nearest Branch of Insurance Company. A certificate to this extent in writing from transporter should reach this office within 72 hours to lodge the claim with insurance.

 

 

6) Company shall not be liable for any action direct or indirect that may be instituted by any one against the transporter arising out of or consequent to the carriage of goods consigned to or from company entrusted to the transporter for transportation.

7a. It shall be the responsibility of the transporter to lift/deliver the consignment from/to designated places in the Company at consignees premises as specified in the despatch documents.

7b. Packing case/marking Nos. should be indicated in the GC Note, similarly GC Note Nos. to be indicated on the corresponding packing case for easy identification.

7c. Holding of Outward consignment by the Transporter booked during the tenure of the contract for any reason whatsoever will amount to breach of contract and the case will be dealt as per provisions of the contract.

 

8) TRANSPORTER AS TRUSTEE ACCOUNTABLE TO ALL GOODS ENTRUSTED

  1. Any destruction deterioration loss or damage caused to entrusted to the transporter for carriage, but if due to whatever reasons shall be made good by the transporter to company not withstanding anything to the contrary in section 151 and 152 of the Indian Contract Act or any other law and further the transporters shall hold the goods entrusted to him by the company for carriage as trustee and be accountable thereof accordingly to company.
  2. The transporter shall be liable for any damages to the companyís property caused by negligent driving. The losses if any will be recovered in the form of penalty not less than the market price of the damage/lost consignment at that time together with incidental charges and expenses.

 

9) TRANSPORTERíS EMPLOYEE NOT EMPLOYEE OF ITI

The transporter shall always be regarded as an independent contractor for carriage, and the transporterís employee shall not at any time be regarded as the employees of the company shall not be liable/responsible for damage, loss or injury if any caused to life or property of any person whether they are employees of the transporter or third parties, by recklessness or negligence on the part of the employees of the transporter or of any person engaged by the transporter in connection with this work of carriage or loading or unloading or any other incidental work. Nor shall the company be liable/responsible for the claims if any, of the employees of the transporter under the workmenís compensation Act or any other enactment of law. The transporter shall keep the company fully indemnified and harmless always against all claims and proceedings if any of his employees or others against the company.

 

10) NO DEMURRAGE/STORAGE CHARGES WHATSOVER ARE PAYABLE BY ITI OR CUSTOMER ON OUTWARD CONSIGNMENTS AS THE CASE MAY BE.

 

11) The transporter should be member of BANKER'S ASSOCIATION during period of contract.

 

 

 

 

12) The period of contract shall be for a Period of two years, which can be extended for a further period of one to two years on mutual consent. On expiry/termination of contract up to a period of three months the carrier will be responsible for delivery of the consignments booked during the contract period at customer's premises. The charges payable shall be as per the agreed freight structure in this contract.

 

13) AGREEMENT

  1. The transporter shall enter into an AGREEMENT with the company within a month of date appointed embodying these and other suitable conditions as may be laid down by company, This agreement shall be valid for a period from _______________ to _______________ (two years from the date of contract) which may be extended by mutual consent at the same rates, terms and conditions. Until such time the agreement is signed, the correspondence pertaining to this tender exchanged will be deemed as terms and conditions of the contract and binding on the parties. If written agreement is not signed by the transporter within specified period, the contract awarded is liable to be terminated and the earnest money deposit will stand forfeited.
  2. Latest Income Tax clearance certificate to be furnished by the transporter to complete the agreement formalities.

 

14) TERMINATION OF AGREEMENT NOTICE PERIOD

  1. The agreement is pre-determinable during its currency by either party giving notice in writing of intention to terminate provided that the notice period shall not be less than three months from the date of service of the notice.
  2. In case of default in complying with the terms of agreement entered into by the transporter satisfactorily or non-provision of lorries as and when required penalties are liable to be levied and any alternative arrangements made will be at the risk and cost of the transporter, and all expenses incurred thereby shall be to the transporters account. If the service continues to be unsatisfactory in spite of two written warning notices, the contract is liable to be terminated without any further reference. On termination of the contract or such action of the transporter the Earnest Money Deposit and Security Deposit shall stand forfeited to the company.

15) RIGHT TO ACCEPT/AWARD THE CONTRACT

  1. Company reserves the right to allocate the contract to one or more transporters for the same route or to none at all at their absolute discretion without assigning any reason thereof.
  2. Company reserves the right to enter into parallel transport contract at anytime at their absolute discretion without assigning the reason.
  3. Company reserves the right to accept or reject any Tender irrespective of its competitiveness, at discretion and without assigning any reason.

16) DIVERSION OF CONSIGNMENTS

In case consignee, indicated by the company, wants the consignment to be diverted to some other consignee, transporter may do so only after getting WRITTEN INSTRUCTIONS from the consignee, claim for any extra charges incurred in this connection, will be admitted, at the rate of Rs.0.65/= per cub. meter per Km. by volume or Rs.1.00/= per MT per KM. by weight. However such claims must be supported with the written instructions of the consignee or ITI in this regard.

 

17) BILLS FOR PAYMENT

  1. Bill for payment of carriage shall be submitted in triplicate duly pre-receipted and supported by a copy goods consignment note, duly acknowledged by the consignee for safe and correct receipt of goods within a maximum period as per clause "4a" from the date of receipt of materials. The figures of weight and measurements indicated in companyís packing notes will be taken into consideration for the purpose of deciding the weight/volume of goods or the full truckload as the case may be.
  2. The following points may please be taken note of while submitting bills to company:

  1. Claims for transportation work done should be calculated to two decimal places only in respect of weight/volume.
  2. Transporter have to ensure correctness of calculations while indicating their claims in the despatch advise/G.C. note and prepare their bills accordingly. Supplementary bills without any valid reason will not be entertained.
  3. Name(s) of place(s) from where the materials were sent to should invariably be mentioned on the G.C. note/bills/despatch advise to enable Company's Accounts Deptt. to adopt the appropriate rates.
  4. The freight bill of the transporter, where concerned GC note contain the remark such as damages/shortages from the consignee, will only be settled when the transporter issue the damages/shortages certificate in this regard. However if the claim is disallowed by the insurance company at a later stage due to any reason attributed to transporter, the entire cost of damage/shortage shall be recovered from the transporter's running bills.
  5. The transporters are advised to submit their bills on, G.C. note basis and on weekly basis in their own interest for early payment.

 

 

 

 

 

 

 

 

18) EARNEST MONEY/SECURITY DEPOSIT

  1. The transporter shall pay an Earnest Money Deposit of Rs.10,000/= (Rupees Ten Thousand only) in the form of Demand Draft payable to company. Such deposit will not carry any interest. The Demand Draft should be submitted along with the Tender documents. Payment by cheque is not acceptable.The Earnest Money stands forfeited by company in case the transporter does not accept the contract within a week's time when once the same is accepted by ITI and awarded to the transporter as per conditions of Tender. If the transporter withdraws the offer within the validity period, the earnest money deposited by him will be refunded to the unsuccessful transporters after the tender is decided.
  2. If the successful Tenderer withdraws the offer after acceptance of his tender or fails to accept the contract and deposit the additional amount required as security deposit within the specified time or fails to take up the work in accordance with the instructions of the company, the amount deposited by him will be forfeited by the company and acceptance of his tender is withdrawn.

  3. The successful transporter shall deposit a sum of Rs.15,000/= (Rupees Fifteen Thousand only) as security deposit in the form of cash or Demand Draft towards satisfactory performance of the contract. No interest becomes payable on this amount whether held as Earnest Money Deposit or Security Deposit. This sum is liable to be forfeited by the company for non-performance of the contract under the agreement as provided herein, or for breach of any of the terms and conditions of the contract on the part of the transporter. In addition the transporter is also liable for any loss or damage suffered by the company by any cause whatsoever until the consignment is safely delivered to the company or to designated consignee as the case may be by the transporter, and such loss or damage will be assessed by the company at its sole discretion.

 

 

19a. The transporter should make sure that no consignment shall remain in their godown after 45 days of expiry of the contract. Such cases must be listed out and handed over to respective Shipping Department for settling mutually with the company.

19b. It must also be ensured by the Transporter that the statements be submitted to respective Shipping Deptt. for outward consignment every fortnight starting from 30 days before expiry till 45 days after expiry of contract for all such outward consignments which remain in the custody of the transporter for delivery to the company or to the designated consignee as the case may be for speedy follow-up of the same.

19c. If desired by ITI transporter will allow our escort along with consignment free of cost and in that case no any bonus will be payable to the transporter.

19d. In those case transporter collects mixed load for truck i.e. MT basis and cub. meter basis, payment would be made to the transporters on the basis of actual weight or volume whichever is higher. In such case material would not be projecting outside the body of the truck.

 

 

 

 

20. Payment to transporter will be cleared within a reasonable time. Transporter may submit a statement of pending bills on monthly basis to I/C Packing/Shipping Deptt. for speedy clearances of bill.

 

 

21. To clear transporters bills full truckload certificate wherever necessary will be issued at the time of lifting of materials.

 

22. No counter terms & conditions in any form either by way of printed condition on G.C. notes or in any other form will be accepted by the company.

 

23. DTS DESPATCHES

In case of DTS despatches the consignments booking point shall be taken same as nearby district HQ distances shall be verified as per TTK Book/maps of India website.

 

24. DISPUTE

All disputes and differences arising out of or in any way touching or concerning the agreement whatsoever, shall be referred to and decided by arbitration at Srinagar and Incharge M/s ITI Ltd., Srinagar, J&K shall appoint such arbitrator by a written order in this behalf. The arbitration shall be done under and in accordance with the provision of the Arbitration and Conciliation Act 1996, and the decision of the Arbitrator shall be final and binding on both the parties to this agreement. The Srinagar courts alone shall have jurisdiction for all litigations, if any, between the parties.
